Harvard Law School’s Animal Law & Policy Clinic filed the lawsuit against the National Park Service for negligence, alleging that the government agency has been allowing Tule elk to die from starvation and dehydration.

Harvard Law’s latest brief asks the court to accelerate the Park Service’s proposed timeline to safeguard the elk’s continued survival. It also asks the court to allow further arguments on behalf of the elk, in particular, on whether the National Park Service should provide relief like adequate food and water in the interim.

Lead attorney Kate Barnekow said the protracted planning process, which would likely not be finished until 2025, would lead to more elk deaths. “We’ve lost half the herd,” she said. “The fact that the park service is now claiming that it needs an additional three years is absolutely unacceptable, and may mean that it will be too late to save the elk.”
